Fixal - AI Photo Enhancer

Welcome to Fixal - AI Photo Enhancer (the "App"), provided to you by Fixal ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) and that you have the right, authority, and capacity to agree to and abide by these Terms. Use of the App is also governed by our Privacy Policy.

2. Description of Service

Fixal provides a suite of AI-powered tools for photo enhancement and creative editing ("Service"). The Service includes, but is not limited to, AI portrait beautification, object removal, background changes, style transfers, and other image processing features. All AI processing is performed by our third-party technology partner.

3. User Account

• Google Sign-In: You may choose to create an account using your Google credentials. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

• Account Deletion: You may delete your account and associated data at any time through the App's settings or by contacting us. Please refer to our Privacy Policy for details on data handling.

4. Acceptable Use & User Responsibilities

You agree not to use the App for any illegal, harmful, or abusive purposes. You are solely responsible for the content (including all photos) you upload, submit, or process through the App ("User Content").

When using AI features, you specifically agree NOT to:

1. Upload or generate content that is illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy, or otherwise objectionable.

2. Use the App to create or disseminate misleading content, including deepfakes, with the intent to deceive, harass, or harm individuals or entities.

3. Upload photos of other individuals without their explicit consent, especially for features that significantly alter a person's appearance (e.g., age, gender changes).

4. Use the App to generate content that violates any applicable laws, regulations, or third-party rights.

5. Attempt to reverse engineer, decompile, or exploit any part of the Service.

We reserve the right, but are not obligated, to review, remove, or disable access to any User Content that we believe, in our sole discretion, violates these Terms.

5. Intellectual Property

• Your Content: You retain all ownership rights to the original photos you upload. By using the Service, you grant us and our third-party AI provider a limited, non-exclusive, worldwide license to transmit, process, and technically store your photo solely for the purpose of providing the enhancement service you requested. This license terminates immediately after processing is complete.

• Our App: The App, including its "Fixal" name, logo, design, and all underlying software and technology, is owned by us or our licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Subscriptions and Payments

• The App may offer both free and premium features accessed via subscription or one-time purchase.

• Payment Processor: All payments are processed by Google Play. You agree to Google Play's Payment Terms. We do not store or handle your payment card information.

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Google Play account settings.

• Refunds: Refunds are subject to Google Play's refund policy. Please contact Google Play Support for payment and refund inquiries.

7. Disclaimers & Limitation of Liability

• Service "As Is": The App and Service are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

• AI-Generated Content: AI outputs are generated by automated algorithms. We do not guarantee the accuracy, reliability, or quality of the results. You are solely responsible for evaluating and using any output generated by the App.

• Third-Party Services: Our reliance on third-party services (AI processing, AdMob, Google Play) means we are not liable for any issues arising from their performance.

• Limitation of Liability: To the maximum extent permitted by law, Fixal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless Fixal, its officers, and licensors from and against any and all claims, damages, liabilities, and expenses arising from: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or the rights of a third party.

9. Termination

We may suspend or terminate your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will cease immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the App or by email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
